تهدف الدراسة إلى التعرف على دور المصارف الإسلامية الفلسطينية في تنمية النشاط الاقتصادي، وبيان تركزات استخدام المصارف الإسلامية الفلسطينية لأدوات التمويل الإسلامية القائمة على مفهوم الملكية والمديونية، وما مدى توزيع التمويلات الممنوحة من قبل المصارف الإسلامية الفلسطينية على مختلف القطاعات الاقتصادية لدفع عجلة التنمية في فلسطين ، وقد خلصت الدراسة إلى أهمية الدور الذي تؤديه المصارف الإسلامية في تمويل التنمية من الناحية النظرية، غير أن النتائج التحليلية لدور المصارف الإسلامية الفلسطينية في تنمية النشاط الاقتصادي أكدت أنها دون التوقعات والمستوى المطلوب، وأن دورها لم يكن فاعلاً بالمقارنة مع مستوى

A few of contemporary Islamic banking and finance practices have raised legal_x000D_ controversies that have led to pose a threat to the emerging industry of Islamic Banking. Controversies like these have also distorted the image of the religion, hence requiring to provide justifications to support the legitimacy of their practice.

Although short selling instruments violate the general Islamic rule of ‘do not sell what you do not own’, they have been legalazied by the Shari’ah Advisory Council (SAC) of Malaysian Securities Commission to be used in Islamic Capital Market in Malaysia. In this paper authors aim to study fiqh issues related to the short selling instruments.
