Abstract

Prior to the recent English High Court decision in the Shamil Bank of Bahrain DC vs. Beximco Pharmaceuticals, there had been little guidance in terms of how Islamic financial contracts should be governed. The English High Court has refused to make judgements on the shari`a compliance of such contracts, leaving those elements instead to individual religious advisory boards, thus setting a firm legal foundation for the administration of Islamic financial contracts.
